In this document, references to "LINQ", "LINQ Capital", "we", "us" or "our" refer to LINQ Capital Pty Ltd and, where applicable, its authorised representatives.

We provide credit assistance and related services including:

  • Home Loans;
  • Refinancing;
  • Property & Investment finance; and
  • Business & Asset Finance.


2. What information do we collect?

When you ask us to assist you with your finance or other services, we may collect personal information about you.

This may include:

  • your name, date of birth and contact details;
  • your residential and postal addresses;
  • identification information and documents;
  • employment and income information;
  • employment history and qualifications;
  • details of your assets, liabilities and expenses;
  • information about your existing loans and credit facilities;
  • consumer and commercial credit information;
  • credit reports and information obtained from credit reporting bodies;
  • property and investment information;
  • information about guarantors or prospective guarantors;
  • information about companies of which you are a director;
  • information relating to insurance applications;
  • sensitive information, including health information, where relevant and permitted by law;
  • information you provide about any vulnerability you may have; and
  • any other information reasonably necessary to provide our services.


3. How do we collect your information?

We may collect information directly from you when you contact us, complete an enquiry or application, provide documents, communicate with us, or ask us to assist with your finance requirements.

We may also collect information from third parties where permitted or required by law, including:

  • credit reporting bodies;
  • credit providers and lenders;
  • insurers;
  • professional advisers;
  • valuers;
  • accountants;
  • employers;
  • other brokers and financial intermediaries;
  • our aggregator or licensee; and
  • other service providers.


4. Why do we collect and use your information?

We collect, use and disclose your information for purposes including:

  • understanding your credit and finance requirements;
  • assessing your eligibility for finance;
  • sourcing suitable credit providers and finance products;
  • assisting with loan and finance applications;
  • assisting with refinancing and property finance;
  • assisting with business and asset finance;
  • assisting with guarantor applications;
  • arranging insurance where requested;
  • managing and administering your application;
  • communicating with lenders and credit providers;
  • complying with legal and regulatory obligations;
  • managing our client relationships;
  • conducting client surveys and improving our services;
  • responding to enquiries and resolving complaints;
  • protecting against fraud and unlawful activities;
  • maintaining business records;
  • processing payments and invoicing; and
  • communicating information about our services where permitted by law.


5. What if you do not provide information?

We may require certain personal, financial and credit information to properly assess your circumstances and assist you with your credit needs.

If you do not provide information we reasonably require, we may be unable to assess your application, source suitable finance, provide credit assistance or provide other services to you.



6. Collection and disclosure of your information

We do not sell, trade or rent your personal information to third parties.

We may disclose your information where reasonably necessary to provide our services or where permitted or required by law.

This may include disclosure to:

  • credit providers and lenders;
  • consumer and commercial credit reporting bodies;
  • Connective Credit Services Pty Ltd and relevant Connective entities;
  • insurers and insurance providers;
  • financial intermediaries and other brokers;
  • professional advisers, including lawyers and accountants;
  • valuers and property-related service providers;
  • contractors, agents and service providers;
  • document custodians and mail houses;
  • technology and cloud service providers;
  • securitisers and other parties involved in finance transactions;
  • government and regulatory bodies;
  • law enforcement agencies where required or permitted;
  • organisations involved in a proposed or actual sale, merger, restructuring or acquisition of our business; and
  • other parties where you have provided consent or disclosure is otherwise permitted or required by law.


7. Credit information and credit reporting

As part of providing credit assistance, we may collect, use and disclose credit-related personal information in accordance with applicable Australian privacy and credit reporting laws.

Where appropriate and with the required consent, we may disclose identification information to a consumer or commercial credit reporting body ("CRS") and obtain information from that CRS for the purpose of assessing creditworthiness and assisting with a credit or guarantor application.

We may use information provided by a CRS to preliminarily assess your credit or guarantor application.

A credit provider to whom we submit an application may also collect information about you from, and disclose information about you to, one or more credit reporting bodies in accordance with applicable laws.



8. Credit providers and lender panel

We may submit your application to one or more credit providers or lenders. Each credit provider may have its own privacy policy and information-handling practices.

The privacy policy of each credit provider may contain additional information about how it collects, uses, holds and discloses your information, including information about credit reporting bodies and overseas disclosures.



9. Information provided to insurers

Where you request assistance with insurance, we may disclose relevant information to insurers or insurance providers to obtain insurance products or quotations on your behalf.



10. Use of artificial intelligence and automated systems

We may use artificial intelligence (AI), machine learning tools and automated systems to assist us in providing our services.

These tools may assist with:

  • extracting information from bank statements and other documents;
  • creating summaries of documents;
  • organising and analysing information;
  • matching your information against lender policies and criteria;
  • administrative processes; and
  • other functions associated with providing our services.

Your personal and credit information may be processed using AI systems operated by us or trusted third-party service providers, including cloud-based services.

Where AI tools are provided by third parties, we take reasonable steps to ensure your information is handled securely and in accordance with applicable Australian privacy laws.

AI and automated systems are used to assist our processes and do not replace our legal, regulatory or professional obligations. Where appropriate, human oversight will be applied.



11. Overseas recipients

Some of the recipients to whom we disclose your personal information may be located outside Australia.

It is not practicable to list every country in which such recipients are located. However, depending on the services and technology used, recipients are likely to include:

  • the Philippines;
  • India; and
  • Nepal.

We may also disclose information to other overseas recipients where reasonably necessary to provide our services or where permitted or required by law.

We take reasonable steps to ensure that overseas disclosures are handled in accordance with applicable Australian privacy requirements.

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide our services, or to comply with applicable legal, regulatory, accounting or document-retention requirements.

When personal information is no longer required, we take reasonable steps to destroy or de-identify it, subject to any legal or regulatory requirement to retain it.

If you believe information we hold about you is inaccurate, incomplete, out of date, irrelevant or misleading, you can ask us to correct it.

You may have additional rights in relation to consumer and commercial credit information under Australian privacy and credit reporting laws.

Depending on the circumstances, these rights may include the ability to:

  • request access to credit-related information held about you;
  • request correction of inaccurate or incomplete credit information;
  • request information about how your credit-related information has been used or disclosed;
  • make a complaint about the handling of your credit information;
  • request a credit reporting body not to use your information for certain direct marketing assessment purposes; and
  • request a credit reporting body not to disclose information where you believe you are a victim of fraud.

19. External Dispute Resolution

If you are not satisfied with the outcome of your complaint, or your complaint has not been resolved within the applicable timeframe, you may have the right to take the matter to an external dispute resolution scheme.

20. Your consent

By asking us to assist you with your credit or finance needs, you consent to the collection and use of the information you have provided to us for the purposes described in this document, subject to applicable privacy and credit reporting laws.

You consent to us obtaining and disclosing information about you where reasonably necessary to:

  • assess your consumer or commercial credit application;
  • assess a guarantor application;
  • assess a credit application made by a company of which you are a director;
  • source finance and credit products;
  • source insurance products where requested;
  • manage your application;
  • comply with legal and regulatory requirements; and
  • provide the services you have requested.


21. Disclosure to credit providers and other organisations

You agree that we may disclose information about you to prospective credit providers, insurers and other relevant organisations where reasonably necessary to obtain the finance, credit or insurance products you require.

We may also disclose information to organisations that provide services to us, including:

  • contractors;
  • agents;
  • printers and mail houses;
  • lawyers and professional advisers;
  • document custodians;
  • securitisers;
  • technology providers;
  • computer systems consultants;
  • cloud service providers; and
  • other service providers reasonably required to support our business.


22. Commercial credit — extended effectiveness

Where applicable to commercial credit, your agreement and consent to the collection, use and disclosure of information described in this document may remain effective for a period of up to 12 months, unless you withdraw your consent earlier by contacting us.

This extended effectiveness is intended to allow us to continue providing services to you without requiring a new privacy consent each time you require commercial credit within that period.

The extended effectiveness described in this section does not apply to consumer credit.



23. Company directors and guarantors

Where you are a director of a company applying for credit, or where you are providing or considering providing a guarantee, you acknowledge that we may collect, use and disclose your personal information in addition to information relating to the company or relevant credit application.

Your information may be used and disclosed for the purposes described in this document, including assessing the relevant credit or guarantee application.

We may update this Privacy Policy from time to time to reflect changes to our business, services, technology, privacy practices or applicable laws.

The latest version will be published on our website. The date at the top of this document indicates when it was last updated.
